UK haulage is regulated by a minefield of legal constraints including domestic health and safety legislation, environmental and traffic laws. This will be compounded by the increasing introduction of European Union legislation We can assist navigating this area EMPLOYMENT LAW We can introduce the provision of a code of practice and attendant procedures to protect you from litigation in the light of challenges over, job descriptions, terms and conditions, discipline, contract law and employee tribunals.
HEALTH & SAFETY We interpret and advise on:
TRAFFIC MANAGEMENT Your operating centre(s) - we can provide an assessment of both your site and the surrounding roads for both their suitability and safety. If you require vehicle counts or speed surveys we can assist. These can help to support any licence applications or help challenge objections at Public Inquiry. If you need help with the full range of traffic systems, signing, parking or one way routes we can design and implement these - what ever you size of operations. ROAD TRANSPORT WORKING TIME DIRECTIVE (RTD)With the introduction of the Road Transport Working Time Directive, the working activities of all mobile workers requires to be monitored, records kept for two years and produced when required to an examining officer. The Vehicle Operator Services Agency (VOSA) who is responsible for policing this legislation recommend that these activities be monitored by companies by way of the tachograph charts which can then be analysed and a report produced which will enable both companies and drivers to ensure that the working time is complied with. If the tachograph charts are not to be used, then separate log sheets are required. At TMC Ltd, the charts and/or other monitoring methods can be analysed in conjunction with the driver's hours' analysis and a report generated allowing all parties to plan schedules and activities in the full knowledge that they are complying with this regulation. DIGITAL TACHOGRAPHS With theintroduction of the digital tachographs, from mid 2006, we at TMC Ltd will be able to download and analyse the information in addition to preparing an easily understood report. In addition and in order to assist our clients, a mobile office is being prepared from where our staff can attend your premises and download the digital information directly onto the databse for further analysis at our offices. It is important to note that whilst legislation has been written and circulated, the industry is still awaiting further changes in the driver's hours legislation all of which will be taken into consideration once implimented. In the transisition period and until the full implications have been finalised, analog tachnographs and the first generation digital tachographs can still be analysed from our offices. |
